ШАРІАТ ЯК ОФІЦІЙНЕ ДЖЕРЕЛО І РЕЛІГІЙНО-МЕТОДОЛОГІЧНА ОСНОВА ПРАВОВОГО РЕГУЛЮВАННЯ ЗЕМЛЕВОЛОДІННЯ ТА ЗЕМЛЕКОРИСТУВАННЯ В ОБ’ЄДНАНИХ АРАБСЬКИХ ЕМІРАТАХ

Abstract

Shariat as a complex of norms and regulations is a religious and methodological basis of land ownership and land tenure in UAE. Scientific character of this system is in its resting on objective (beyond human control) and proved by practice knowledge about the nature, community and thinking including the knowledge about the land as a nature element and an object of real estate. In Shariat in the part grounding Muslim law the land law is not outlined as an independent field (sub-field) of legal science as well as the legal science itself exists just in the form of scientific and religious system of views.  UAE democratization with certain orientation towards continental European countries puts the task of holding academic researches on elaboration of land law as it was done in such countries. One of methodological basis of such researches is Shariat intending to keep UAE as an Islamic state. Religious verities proved by centuries could be a reliable support in building and developing modern market relation in globalizing world.
